There were 131 alcohol related car fatalities in Minnesota in 2009. In Minnesota it is a crime to drive a vehicle with the influence (DWI) of alcohol, a controlled substance, or a combination of the two. It is also illegal to have a blood alcohol concentration (BAC) of .08 or higher within 2 hours of driving. Any amount of a controlled substance in the drivers blood, such as cocaine or marijuana, is illegal too. If the driver is operating a commercial vehicle, then they have a BAC limit of .04. A BAC of .20 or more leads to an aggravated DWI.

A first time DWI offender in Minnesota faces a jail term of up to 90 days and a fine of up to $1,000. Their license will be suspended for a maximum of 90 days. If their BAC is .20 or above, or if there is a passenger in the car under 16 years old, then the license suspension will last 180 days. If the driver refuses the BAC test, their license will be suspended for 1 year. If there are no aggravating factors, the driver can apply for a limited license after 15 days. License reinstatement costs a total of $694.
